Roxy became very ill in late April 2023. Police would not investigate this as abuse. I filed a lawsuit against the City of Portland in late June seeking injunctive relief and damages. Since January 2014 I have been unable to get legal representation for any of the harms that I have suffered, so I represented myself. In November, Judge Michael Greenlick denied me an evidentiary hearing for injunctive relief. Biomedical retaliation against both Roxy and me came within 3 hours of his decision and as of this writing, has not ended. The lawsuit was dismissed for failure to state a claim because, according to Judge Shelly Russell, there is no civil cause of action to police lack of enforcement of crimes against animals, and even though ORS 133.379 mandates the arrest of animal abusers, according to the Judge, this does not extend to mandating a criminal investigation of animal abuse (IMO this should have been for a jury to decide). The Judge also said that I should not make a claim for civil conspiracy, even though, to me, it seems rather obvious that a conspiracy exists, and that it involves the City of Portland.
